Have your say on potential reforms to address corporate misuse of the Fair Entitlements Guarantee

The Department of Employment and Workplace Relations (DEWR) is consulting about potential reforms to strengthen the legal framework to address corporate misuse of the Fair Entitlements Guarantee (FEG).

FEG is a scheme of last resort that guarantees eligible employee entitlements in the event of business failure, where no alternative avenue exists to fund these entitlements. Once funds have been advanced to former employees, DEWR steps in their shoes as a creditor in the liquidation or bankruptcy of the former employer. More information about FEG and the FEG Recovery Program is available on the department's website.

Addressing corporate misuse of FEG discussion paper

DEWR has released the Addressing corporate misuse of the Fair Entitlements Guarantee discussion paper which identifies potential reforms.

The discussion paper is available here.

DEWR invites stakeholders to make submissions responding to the questions raised in the paper.

DEWR wants to hear from interested stakeholders, including:

  • individuals and organisations that work in, or interact with, the insolvency industry

  • peak bodies and organisations

Stakeholders are invited to make a submission by 31 March 2025.
